Chef Terms Of Use

Acceptance of the Chef Terms of Use

These terms of use are entered into by and between you, a professional chef seeking to become a Chef on our platform (“you” or the “Chef”), and INTUEAT, Inc. (“INTUEAT,” “Company,” “we,” or “us”). The following terms and conditions, (“Chef Terms of Use”) govern Chef's access to and use of INTUEAT’s platform (the “Platform”). Once you become a Chef on the Platform, your services will be further governed by our Independent Contractor Agreement. If you do not agree to these Chef Terms of Use, you must not use our Platform. Furthermore, Pursuant to the Accountability System (defined below), we reserve the right, in our sole discretion, to remove you from our Platform.

INTUEAT’s Standardization rules

All Chefs on the Platform must:
  • Have a compliant commissary affidavit on file with INTUEAT
  • Provide the Minimum Booking Requirements (outlined below) 
  • Deliver on Our Expectations (outlined below)
  • Comply with the Zero-Tolerance Rules (outlined below)  

Minimum Booking Requirements

When you create your profile on the Platform, you must include the following in your base price point:
  • A minimum of a 3-course menu,
  • Food cost for the 3-course menu 
  • All cookware
  • All flatware & tableware
  • Transportation
  • Service staff if needed
  • Post-event cleaning up

Our Expectations

Chefs on the Platform are expected to comply with the following expectations:
  • Maintain and update an availability calendar within your account on our Website to indicate when you are and are not available for bookings.
  • Ensure that your profile information and contact information remain accurate and up-to-date.
  • Respond to all event requests from Hosts (“Event Requests”) within 24 hours (the “Acceptance Period”). Acceptance may occur by responding YES or NO + the event unique 4-digit identification code to an Event Request via Text Message
  • Respond to all incoming client questions within a reasonable time frame of 24-48 hours and in a professional manner.
  • Inform INTUEAT via the contact form in the Platform or email of up-sales, pricing changes, event structure changes, issues, and any other critical information that may affect client expectations, billing, or event execution.
  • IMMEDIATELY INFORM INTUEAT IF YOU ARE UNABLE TO PERFORM SERVICES FOR ANY REASON AFTER THE BOOKING ACCEPTANCE.
  • Obtain our prior written consent before using any INTUEAT content online or for your business purposes, such as marketing. We may decline permission due to licensing or copyright restrictions from the content producers. Certain content will require proper tagging of the content producers.
  • Comply with the terms of your Independent Contractor Agreement.

Zero Tolerance Rules

We do not tolerate any of the following behavior on our Platform. Pursuant to the Accountability System, we reserve the right, in our sole discretion, to remove you from our Platform if we have knowledge of, or reasonable cause to suspect, any of the following:
  • Unprofessionalism in any way
  • Submission of stock footage or other content in which you do not have the rights or that you have not created
  • Dishonesty in  any information submitted during the recruitment process, onboarding process, or upload process
  • Creating an unsafe situation in any manner via our chat relay system
  • Sharing your Personal Information to allow the circumvention of the INTUEAT Platform
  • Communicating with Hosts outside of the Platform, i.e. via personal call, personal text, or email
  • Attempting to circumvent our platform in any way, such as by advertising your services on another platform or by accepting direct bookings through other mediums such as phone, text, or email
  • Misrepresentation of your skills, yourself, or who you claim to be
  • Sharing of Host Personal Information with third-parties 
  • Harassing behavior of any kind to INTUEAT employees or Hosts 

ACCOUNTABILITY SYSTEM

We reserve the right, in our sole discretion, to remove you from our Platform at any time for violations of these Chef Terms of Use, the Zero Tolerance Rules, or your Independent Contractor Agreement, based on the following accountability system (the “Accountability System”):

 

Accepting Event Requests: You are required to maintain an accurate availability calendar and respond to all Event Requests within the Acceptance Period. Failure to respond to an Event Request within the Acceptance Period OR ignoring an Event Request made for a time period marked as “available” on your calendar will result in the following consequences:
First Instance:

A written warning via [email/text message] notifying you of this issue. [If the Event Request is unreasonable, please respond to us via email, contact form submission, phone call, or text explaining the situation and reason for declining.]

Second Instance:

A phone call from us warning you of this issue.

Third Instance:

30-day suspension from the Platform. During a suspension, your profile is hidden and not viewable by Hosts for thirty (30) days.

Fourth Instance:

Termination from the Platform.

Standardization Rules: You are required to comply with the Standardization Rules outlined in this Chef Terms of Use. Failure to comply with the Standardization Rules will result in the following consequences:
First Instance: 

A written warning via [email/text message] notifying you of this issue.

Second Instance:

A temporary suspension from the Platform for 30 days and until you can demonstrate compliance with the Standardization Rules. The length of this suspension will be determined on a case-by-case basis.

Third Instance:

Termination from the Platform.

Poor Performance: Poor performance is defined as failure to perform any aspect of the services in a manner reasonably expected of a professional chef, or receiving multiple (2) negative client reviews within a 90-day period.  Continuous poor performance, may result in permanent termination of your profile.
First Instance:

A written warning via [email/text message/in the platform] notifying you of this issue.

Second Instance:

A phone call from us warning you of this issue.

Third Instance:

A 60-day suspension from the Platform to correct any issues that may be identified by INTUEAT at that time

Fourth Instance:

Failure to correct performance issues will lead to Termination from the Platform.

Chefs who have been terminated from the Platform must wait six months before re-applying. Chefs who re-apply will be added to the waiting list for consideration, with no guarantee of re-acceptance.

Chef Personalization and Custom Policies

At any point Chef may request and submit edits on any of the line items listed below
  • Your headshot
  • Food pictures
  • Your Bio
  • Your Experience
  • Maximum & minimum headcount
  • Minimum event price
  • Service radius
  • Your Availability Calendar (updated instantly)
  • Your “tags” or disciplines
  • Your cancelation policies (as defined in the Booking and Cancellation Policy)
  • Your lead times
  • Your price per individual guest count
  • Your active or inactive profile status
  • Your menu design
  • Your event design per Host specifications

Custom Policies

Chefs may request custom parameters to certain functionality on our platform, including:
  • Adding an automatic [20%] gratuity to bookings,
  • A cancellation policy per our Booking and Cancellation Policy
  • A personalized statement of good faith, or
  • Other requests that do not interfere, contradict or nullify, INTUEAT's legal requirements - as determined on a case-by-case basis

No custom policy shall conflict with these ANY legal terms set forth by INTUEAT including but not limited to our Privacy Notice, Terms of Use, Chef Terms of Use, your Independent Contractor Agreement, or the Booking and Cancellation Policy

Chef Performance Tracking

We track the following performance metrics when you use our Platform. For more information on how we collect and process your other Personal Information, please review our Privacy Notice.
