Acceptance of INTUEAT's Privacy Notice

Thank you for choosing to be part of our community at Intueat, Inc. ("Company", "we", "us", "our"). This is the privacy notice (“Notice”) of the Company. This Notice governs data we may collect from you when you access and use our website at https://www.intueat.com, (the “Website”), or when you request customer service from us, through phone, email, or if you otherwise interact with us (collectively, together with the Website, our “Services”).

By using the Website or otherwise interacting with and providing Personal Information (defined below) to the Company, you accept and agree to be bound and abide by this Notice.  This Notice is incorporated into our Terms of Use. We are committed to protecting your Personal Information and your right to privacy. When you use any of our Services, we appreciate that you are trusting us with your Personal Information. We take your privacy very seriously. In this Notice, we seek to explain to you in the clearest way possible what information we collect, how we use it and what rights you have in relation to it. We hope you take some time to read through it carefully, as it is important. If there are any terms in this Notice that you do not agree with, please discontinue use of our Services immediately.

Scope

This Notice describes how we collect, use, disclose, and process your Personal Information (as defined below) and your choices and rights with respect to how we process that Personal Information.   This Notice does not apply to information processed by third parties, for example, when you visit a third-party website or interact with third-party services, unless those parties collect or process information on our behalf. Please review any relevant third-party privacy policies for more information.

Please read this Notice carefully as it will help you understand what we do with Personal Information. 

1. WHAT INFORMATION DO WE COLLECT?

In Short: We collect a variety of different types of Personal Information depending on how you interact with us.

In order to provide our Services, we may collect and process information that relates to identified or identifiable individuals (“Personal Information”). We collect and process the following categories of Personal Information (note, specific Personal Information elements are examples and may change): 

Identity Data: Personal Information about you and your identity, such as your name, phone number, age and/or age range, information you provide in connection with becoming a customer, chef, or employee, and other Personal Information you may provide when you use our Services. 

Contact Data: Personal Information used to contact an individual, e.g. email address, phone number or mailing address. 

Device/Network Data: Personal Information relating to your device, browser, or application e.g. IP address, MAC address, application ID/AdID/IDFA, identifiers from cookies, session history and similar browsing metadata, and other data generated through applications and browsers, including via cookies, tracking pixels, and similar technologies.

Commercial Data: Information about the Services we provide to you and about transactions you make with us or other companies operating through us or on our behalf, information relating to Services you use, what has been provided to you, when and where, and similar information.

Inference Data:  Personal Information used to create a profile about you reflecting your preferences, characteristics, market segments, likes, favorites and other data or analytics provided about you by third parties or data aggregators, including household data, the products and services you use or intend to use or purchase, and your interests.

Audio/Visual Data: Recordings and images collected from surveillance cameras when you visit our physical office, as well as audio files and records, such as voice mails, call recordings, text messages, and the like.

Health Data: Information about your health (for example when you send us information about food allergies or dietary preferences).

User Content: Unstructured/free-form data that may include any category of Personal Information, e.g. data that you give us in free text fields such as comment boxes, answers you provide when you participate in sweepstakes, contests, and surveys, including any other Personal Information which you may provide through or in connection with our Services.

2. HOW DO WE COLLECT PERSONAL DATA?

In Short: We collect Personal Information from various sources based on the context in which the Personal Information will be used.

You: We collect Personal Information from you directly, for example, when you register on our Website, input information into an online form, register for our Services, participate in one of our promotions, enter a contest or giveaway, or provide Personal Information to our employees or contractors so that they can provide certain Services to you. All Personal Information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such Personal Information.


Your Devices: We may collect certain Personal Information automatically from your devices when accessing the Website. For example, we collect Device/Network Data automatically using cookies and similar technologies when you access our Website, or when you open our marketing communications.

Service Providers: We receive Personal Information from third parties with whom we have a relationship, such as our hosting provider, email marketing service, and others.

Aggregators and Advertisers: We receive Personal Information from ad networks, behavioral advertising vendors, market research, and social media companies or similar companies that provide us with additional Personal Information such as Inference Data.

Data we create or infer: We, certain partners, and third parties operating on our behalf create and infer Personal Information based on our observations or analysis of other Personal Information processed under this Notice, and we may correlate this data with other data we process about you. We may combine any Personal Information about you that we receive from you with Personal Information we receive from third parties.

3. HOW DO WE PROCESS YOUR DATA?

In Short: We process Personal Information in a variety of contexts for certain purposes, as well as for the specific business purposes described below.

Using the Services: We generally process Identity Data, Contact Data, Commercial Data, and Device/Network Data when you use our Services. We generally use this as necessary and in order to maintain and provide the Services and features you request. For example, we may process Identity Data, Contact Data, or Health Data when you request to host a dinner party. We may process, analyze and share Identity Data, Contact Data, Commercial Data, Device/Network Data, and User Content in order to provide our Services.

When you make a purchase: We generally collect Identity Data, Contact Data, Device/Network Data, and Commercial Data when you purchase Services or gift cards through our Website. We generally process this Personal Information to fulfill your purchase. We may store Commercial Data for our purposes, for example, to personalize the Services, and help recommend relevant offers or services.

Contests and Promotions: We collect and process Identity Data, Contact Data, and User Content as necessary to process your request to enter contests, or take part in a promotion, notify you if you have won or to process delivery of a prize or for other related purposes. In some cases, we may collect this information from social media companies, if we feature a contest or promotion on their platform. In addition, we may process this information in connection with our legitimate business interests, such as verifying your identity for authentication and security purposes, and helping us to prevent fraud. Note, if you win a contest/sweepstakes, we may publicly post some of your data on the Website. Where required by law, your information will not be posted without your consent.

Feedback and Surveys: We may process Identity Data, Contact Data, Inference Data, and User Content collected in connection with feedback provided by customers, guests, or chefs, or from surveys or questionnaires. We generally process this Personal Information as necessary to respond to requests/concerns, and create aggregate analytics regarding customer satisfaction. We may store and analyze feedback for our purposes, for example, to personalize the Services, and help recommend relevant offers or services.

Chat Relay System: We may process Identity Data, Contact Data, Device/Network Data, and User Content when you communicate through the INTUEAT chat relay system. We generally process this Personal Information as necessary to facilitate communication between Hosts and Chefs. We may process and analyze this Personal Information as necessary to respond to user requests, such as safety or harassment concerns.

Marketing Communications: We may process Identity Data, Device/Network Data and Contact Data in connection with text, MMS, SMS, and email marketing communications, which you might receive if you choose to receive marketing communications or engage in a transaction with us. We may also automatically collect Device/Network Data when you open or interact with those marketing communications.

Contact Us:  When you contact us though the Website using a contact us box, or via email, we process Personal Information such as Identity Data, Device/Network Data, and any Personal Information contained within any User Content. We use Identity Data, Contact Data, and User Content as necessary to communicate with you about the subject matter of your request and related matters. We may use third party service providers who provide these services and collect data on our behalf.

Employment Applications: We may process Personal Information in connection with your application to be one of our chefs, or otherwise provide services to us. We process this Personal Information primarily in connection with the personnel or service provider relationship. Details regarding our collection and processing of Personal Information for these purposes may also be subject to our internal policies.

Cookies and Similar Tracking Technologies: We, and certain third parties, automatically collect and process Identity Data, Contact Data, and Device/Network Data when you interact with cookies, tracking pixels, and similar technologies on our Services. Certain technologies may provide recordings of our users’ sessions on our Website, as well as heatmaps of our Website use, and we use this information for Website optimization. Some of these technologies can be used to identify you across platforms, devices, sites, and services. Please see our Cookie Policy  for further information on the cookies and similar tracking technologies we use.

Business Purposes of Processing: In addition to the processing described above, we generally process Personal Information for several common purposes in connection with our business. For example, we process your Personal Information:
  1. To Provide our Services and Fulfill Obligations. We process any Personal Information as is necessary to provide the Services and otherwise fulfill our obligations to you, e.g. to provide you with information or Services you request.
  2. Internal Processes and Service Improvement. We may use Personal Information in connection with our improvement of the design of our Services, understanding how our Services are used or function, for customer service purposes, in connection with the creation and analysis of logs and metadata relating to our Services, for ensuring the security and stability of the Services, and to understand how our Services perform, or we may analyze use of the Services to determine if there are specific activities that might indicate an information security risk to the Services or our users.
  3. Security and Incident Detection. Whether online or off, we work to ensure that our Services and Website are secure. We may process any Personal Information we collect in connection with our legitimate business interest in ensuring that our Website is secure, identify and prevent crime, prevent fraud, and ensure the safety of our guests. Similarly, we process Personal Information as necessary to detect security incidents, protect against, and respond to malicious, deceptive, fraudulent, or illegal activity. We may analyze network traffic, device patterns and characteristics, maintain and analyze logs and process similar Personal Information in connection with our information security activities.

Aggregate Analytics: We process Personal Information in connection with our creation of aggregate analytics relating to how our Services are used, trends, and to create other reports regarding the use of our Services, demographics of our users, and other similar information and metrics. We may pass the aggregated data to certain third parties to give them a better understanding of our business and to improve our Services. The resulting aggregate data will not contain information from which an individual may be readily identified.

Personalization: We process certain Personal Information in order to personalize certain aspects of our Services. For example, aspects of our marketing communications may be customized to you based on your interactions with our Services. This processing may involve the creation and use of Inference Data relating to your preferences.

Targeted Advertising: We and certain third parties may engage in targeted advertising on our Website or through our marketing communications. These parties may be able to identify you across sites, devices, and over time. The parties that process Personal Information for behavioral advertising may create or leverage information derived from personalization and profiling. In some cases, these parties may also develop a profile about you and may also track whether you view, interact with, or how often you have seen an ad. We generally use targeted advertising for the purpose of marketing our Services.

Compliance, Health, Safety & Public Interest: Note that we may, without your consent or further notice to you, and to the extent required or permitted by law, process any Personal Information subject to this Notice for purposes determined to be in the public interest or otherwise required by law. For example, we may process information as necessary to fulfill our legal obligations, to protect the vital interests of any individuals, or otherwise in the public interest or as required by a public authority.

Other Processing of Personal Information: If we process Personal Information in connection with our Services in a way not described in this Notice, this Notice will still apply generally (e.g. with respect to users' rights and choices) unless otherwise stated when you provide it.

4. WILL YOUR INFORMATION BE SHARED WITH ANYONE?

In Short: Information we collect may be shared with a variety of parties, depending upon the purpose for and context in which that information was provided. We generally transfer data as described below.
  1. Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
  2. Affiliates. In order to streamline certain business operations and develop products and services that better meet the interests and needs of our customers, and for other permitted purposes, we may share your Personal Information with any of our current or future affiliated entities, subsidiaries, and parent companies.
  3. Contractors, Service Providers, Business Partners. We may share Personal Information with service providers who provide certain services or process data on our behalf. For example, we may disclose information to chefs so that the chef you’ve selected for an event may contact you.
  4. Partners. We may offer you the opportunity to use services operated by third parties, and if you choose to use these services, we may disclose certain Personal Information requested by such third party, or that you direct us to provide to them.
  5. Data Aggregators. In connection with our marketing operations, and subject to your rights and choices, we may share certain Personal Information with data aggregators. These disclosures can help better personalize our Services, and help ensure that you see advertisements that are more relevant to your interests.
  6. Legal Disclosures. In limited circumstances, we may, without notice or your consent, access and disclose your Personal Information, any communications sent or received by you, and any other information that we may have about you to the extent we believe such disclosure is legally required, to prevent or respond to a crime, to investigate violations of our Terms of Use, or in the vital interests of us or any person. We may, in our sole discretion (but without any obligation), object to the disclosure of your Personal Information to such parties.
  7. Other Users. When you share personal information, use our chat relay system, or otherwise interact with public areas of the website, such personal information may be viewed by all users and may be publicly made available outside the in perpetuity.

5. IS YOUR INFORMATION TRANSFERRED INTERNATIONALLY?

In Short: We may transfer, store, and process your information in countries other than your own.

Our servers are located in the United States. Although we currently do not intentionally market our Services outside of the U.S., if you are accessing our Website from outside the U.S., please be aware that your information may be transferred to, stored, and processed by us in the U.S. and by those third parties with whom we may share your Personal Information (see "WILL YOUR INFORMATION BE SHARED WITH ANYONE?" above), which may be in the U.S. or other countries.  These countries may not necessarily have data protection laws or other similar laws as comprehensive as those in your country. We will, however, take all necessary measures to protect your Personal Information in accordance with this Notice and applicable law.

6. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice unless otherwise required by law.

We will only keep your Personal Information for as long as it is necessary for the purposes set out in this Notice, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). No purpose in this notice will require us keeping your Personal Information for longer than necessary.

 

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

7. DO WE COLLECT INFORMATION FROM MINORS?

In Short: We do not knowingly collect data from or market to children under 18 years of age.

We do not knowingly solicit data from or market to children under 18 years of age. By using the website, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the website. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. 8. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: You may have the following choices regarding the Personal Information we process, to the extent required under applicable law:

Consent: If you consent to processing, you may withdraw your consent at any time. You may be required to cease using our Services where your consent is necessary to perform essential aspects of our Services. 

Direct Marketing: You have the choice to opt-out of or withdraw your consent to marketing communications. You may exercise your choice via the links in our communications or by contacting us. 

Cookies & Similar Tech: We use HotJar to provide aggregate analytics on our website. You may view the HotJar privacy policy here and you may opt-out of tracking for HotJar here. You may also opt-out or withdraw your consent to other online advertising and to certain tracking. You must opt-out of certain third-party services directly via the third party. For example, to learn more about how Google uses data when you visit our Website please visit https://policies.google.com/technologies/partner-sites. Users may opt-out of Google Analytics by visiting the Google Analytics Opt-out page, or to opt-out of Google’s use of cookies, visit Google’s Ads Settings here. Other Rights:  Based on the applicable laws of your residence location, and whether we are subject to those laws, you may have the right to request access to the Personal Information we collect from you, change that information, delete it in some circumstances, or exercise other rights. To exercise any applicable rights you may have with regard to your Personal Information, please submit a request by email to Support@intueat.com. We will respond to your request within the time period required by applicable law.

Account Information: If you would at any time like to review or change the information in your account or terminate your account, you can. Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use and/or comply with applicable legal requirements.

Opting out of email marketing: You can unsubscribe from our marketing email list at any time by clicking on the unsubscribe link in the emails that we send or by contacting us using the details provided below. You will then be removed from the marketing email list — however, we may still communicate with you, for example, to send you service-related emails that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes. 9.   CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. We do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online.

10. DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: Yes, if you are a resident of California, you are granted specific rights regarding access to your personal information.  Please note that Inteuat is not currently subject to the CCPA. 

California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to Support@intueat.com.

 

If you are under 18 years of age and reside in California, you may have the right to request removal of unwanted data that you publicly post on our website. To request removal of such data, please contact us using the contact information provided below, and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the website, but please be aware that the data may not be completely or comprehensively removed from all our systems (e.g. backups, etc.).

11. WHAT ABOUT SECURITY?

We implement and maintain reasonable security measures to safeguard the Personal Information you provide us. However, we sometimes share Personal Information with third parties as noted above, and though we may enter contracts to help ensure security, we do control third parties’ security processes. We do not warrant perfect security and we do not provide any guarantee that your Personal Information or any other information you provide us will remain secure.

12. DO WE MAKE UPDATES TO THIS NOTICE?

In Short: Yes, we will update this Notice as necessary.

We may update this Notice from time to time. The updated version will be indicated by an updated "Modified" date and the updated version will be effective as soon as it is accessible. If we make material changes to this Notice, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this Notice frequently to be informed of how we are using and protecting your information.
